Terms of service
These General Terms and Conditions of Sale (GTC) apply to all orders placed on the website smwordofficial.com, operated by SM WORD (Ousmane Dia), a sole proprietorship registered under SIREN number 104844287, whose registered office is at 47 Rue Vivienne, 75002 Paris, France. Any order placed on the site implies full and unreserved acceptance of these GTC.
Article 1 — Products
SM WORD sells gaming and high-tech accessories (headphones, controllers, projectors and related accessories). The essential characteristics of each product are shown on its product page. Photos and visuals are for illustration purposes; slight variations in appearance (packaging, colors) may exist compared with the photo.
Article 2 — Prices
Prices are shown in euros (€), including all taxes. SM WORD reserves the right to change its prices at any time, it being understood that the price shown on the product page at the time of the order is the only one applicable to the buyer. Shipping costs, where due, are shown before the final validation of the order.
Article 3 — Orders
The order is validated when the customer has completed the entire ordering process (selection of the product(s), delivery information, choice of payment method) and made the payment. A confirmation email is sent to the address provided by the customer. SM WORD reserves the right to cancel or refuse any order in the event of a prior dispute, a confirmed stock shortage or suspected fraud.
Article 4 — Payment
Payment is made online at the time of order, using the payment methods offered on the site (bank card and other methods displayed at checkout). The transaction is secured by our payment provider.
Article 5 — Delivery
Orders are shipped from our partner warehouses and delivered to the address provided by the customer when ordering. The indicative delivery time is 10 to 20 business days depending on the destination and the product ordered, as detailed on our Shipping page. SM WORD cannot be held responsible for a delay attributable to the carrier or to events beyond its control (customs, strikes, force majeure).
Article 6 — Right of withdrawal and returns
In accordance with the French Consumer Code, the customer has 14 days from receipt of the order to exercise the right of withdrawal, under the conditions detailed on our Returns & Refunds page.
Article 7 — Warranties
All products sold by SM WORD benefit from the legal guarantee of conformity (Articles L.217-3 et seq. of the French Consumer Code) and from the guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code). In the event of a defective product, the customer may contact us at smword23.pro@gmail.com to obtain repair, replacement or a refund.
Article 8 — Liability
SM WORD cannot be held liable for non-performance of the contract in the event of force majeure, total or partial disruption or strike of postal services or means of transport, or in the event of misuse of the products by the customer, contrary to the instructions provided.
Article 9 — Personal data
The information collected when ordering is necessary to process the order and is handled in accordance with our Privacy Policy. The customer has the right to access, rectify and delete their data, which they can exercise by writing to smword23.pro@gmail.com.
Article 10 — Governing law and disputes
These GTC are governed by French law. In the event of a dispute, the customer is invited to contact SM WORD amicably at smword23.pro@gmail.com before any legal action. Failing an amicable resolution, the French courts shall have sole jurisdiction.
